Terms of Service

1. Who we are

Retaincast (the "Service", at retaincast.com and app.retaincast.com) is operated by Media Yard LLC ("Media Yard", "we", "us"), a New Jersey limited liability company. By using the Service you agree to these Terms. Where you use the Service as a business subject to EU or UK data-protection law, the Data Processing Addendum forms part of these Terms.

2. The Service

Retaincast provides pre-publish audience-retention analysis for videos and scripts, publishing to third-party video platforms you connect, and analytics on published videos, including a comparison of predicted and actual retention. The Service is in early access: features may change, be interrupted, or be discontinued, and analysis quotas may apply. Our use of AI is described in the AI Policy.

3. Your account and keys

You are responsible for keeping your access credentials and API keys confidential and for all activity under them. Tell us promptly at support@retaincast.com if you believe your access has been compromised. We may suspend access that we reasonably believe is abusive, unlawful, or a risk to the Service or other users.

4. Your content

You keep all ownership of the videos, scripts, thumbnails, and other content you submit. You grant Media Yard a limited license to host, process, analyze, and transmit that content solely to operate the Service — for example, storing an upload, analyzing it to produce a prediction, or delivering it to a platform you told us to publish to. You are responsible for having the rights to the content you submit and publish.

5. Connected platforms

Publishing and analytics depend on third-party platforms (YouTube, TikTok, Instagram), and your use of them through Retaincast is also governed by their terms. In particular, the Service uses YouTube API Services; by connecting a YouTube channel you also agree to the YouTube Terms of Service. You can disconnect a platform at any time — for Google, via your Google security settings. We are not responsible for the acts, policies, or availability of third-party platforms.

6. Predictions are estimates

Retention predictions, scores, and recommended edits are analytical estimates, not guarantees. Audience behavior, platform algorithms, and distribution are outside our control, and we make no promise about the views, retention, revenue, or performance of any video.

7. Acceptable use

• No unlawful, infringing, or deceptive content or use.
• No attempts to probe, overload, or disrupt the Service, or to circumvent quotas or access controls.
• No reselling or white-labeling the Service without our written agreement.

8. Fees

The Service offers a free tier and paid plans. Early-access pricing commitments shown at signup are honored as described there. Prices for new terms may change with notice. If a paid plan lapses, your account may be moved to the free tier.

9. Our property

The Service — its software, models, design, and branding — belongs to Media Yard and its licensors. These Terms give you no rights in it other than the right to use the Service.

10. Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, Media Yard will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability for any claim relating to the Service is limited to the greater of US $50 or the amounts you paid us for the Service in the twelve months before the claim. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

12. Termination

You may stop using the Service at any time. We may suspend or end access for breach of these Terms, with notice where practical. Sections that by their nature should survive (4, 9–13) survive termination.

13. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. The state and federal courts located in New Jersey have exclusive jurisdiction over disputes arising from these Terms or the Service, except that nothing in this section deprives a consumer of mandatory protections of the law of their home country.

14. Changes

We may update these Terms; the "Last updated" date will change and material changes will be flagged on the site or by email. Continued use after a change means you accept it.
